Welcome to Stromation Homes ("Stromation," "we," "us," or "our"), a service of Stromation. We operate the website homes.stromation.com (the "Site") and provide a free real estate agent matching service for buyers and sellers in the Dallas-Fort Worth (DFW) Metroplex, Texas.

By accessing or using our Site, submitting a form, or communicating with us via email or text message, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Site or services.

1. Service Description

Stromation Homes is a real estate lead generation and agent matching service. We help home buyers and sellers in the DFW Metroplex connect with licensed, local real estate agents who can assist with their transaction.

Our service includes:

• Collecting information about your real estate needs through our website forms
• Qualifying your inquiry to understand your timeline, budget, and goals
• Matching you with a licensed real estate agent who serves your area and price range
• Facilitating the introduction between you and your matched agent

2. Free Service and Referral Model

Our service is completely free to you. You will never be charged a fee by Stromation Homes for using our Site, submitting a form, or being matched with an agent.

We earn revenue through a referral fee arrangement with real estate agents. When a transaction closes successfully, the matched agent pays Stromation a referral fee (a percentage of their commission). This referral fee:

• Is paid by the agent, not by you
• Does not increase the cost of buying or selling your home
• Is disclosed to all parties involved in the transaction
• Complies with Texas Real Estate Commission (TREC) regulations and National Association of Realtors (NAR) guidelines

3. Eligibility and User Obligations

By using our Site and services, you represent and agree that:

• Legal age: You are at least 18 years of age and legally capable of entering into binding agreements.
• Accurate information: All information you provide through our forms, emails, or text messages is truthful, accurate, and complete. You will not submit false names, phone numbers, email addresses, or property details.
• Lawful use: You will use our Site and services only for lawful purposes related to buying or selling real estate.
• No interference: You will not attempt to disrupt, overload, or interfere with the operation of our Site, services, or systems.
• No scraping: You will not use automated tools to scrape, crawl, or extract data from our Site without our written permission.
• Single account: You will not submit duplicate or fraudulent inquiries.

We reserve the right to refuse service, remove leads, or block access to anyone who violates these obligations.

4. No Guarantee of Results

Specifically, we do not guarantee:

• That you will be matched with an agent (your area, price range, or timeline may fall outside our current network)
• That your matched agent will meet your expectations or preferences
• That you will successfully buy or sell a property
• That any particular price, timeline, or terms will be achieved in a transaction
• That our Site will be available without interruption or error

Real estate transactions involve many variables beyond our control, including market conditions, financing, inspections, and the decisions of all parties involved.

5. Agent Relationship

The real estate agents we match you with are independent, licensed professionals. They are not employees, contractors, or representatives of Stromation Homes. We do not control, supervise, or direct their work.

When you are matched with an agent:

• Your relationship with the agent is between you and the agent directly
• The agent's advice, opinions, and actions are their own and do not represent Stromation
• Any agreements you sign with the agent (listing agreements, buyer representation agreements, etc.) are between you and the agent
• We are not responsible for the agent's performance, conduct, or the outcome of your transaction
• You are free to choose not to work with the matched agent at any time

We vet agents in our network for active licensing and local market coverage, but we do not guarantee their qualifications beyond that.

6. Communication Consent

By submitting a form on our Site, you consent to receive follow-up communications from Stromation Homes related to your real estate inquiry. These communications may include:

• A welcome email confirming your submission
• Qualification emails to understand your needs and timeline
• Agent match notifications with your assigned agent's contact information
• Follow-up messages related to your inquiry

Some of these communications may be generated or assisted by artificial intelligence (AI). For details on how we use AI in our communications, please see our Privacy Policy.

You may opt out of non-essential communications at any time by replying STOP or UNSUBSCRIBE to any email, or by emailing team@stromation.com.

7. SMS/Text Messaging Terms

If you opt in to receive text messages by checking the SMS consent checkbox on our forms, the following terms apply:

• Consent: By opting in, you expressly consent to receive text messages from Stromation Homes at the phone number you provide. Your consent is not a condition of using our service or purchasing any goods or services.
• Message types: You may receive messages related to your real estate inquiry, including welcome messages, qualification questions, agent match notifications, and appointment reminders.
• Message frequency: You will receive approximately 4 messages per month, though frequency may vary based on your interactions.
• Rates: Message and data rates may apply. Your carrier's standard messaging rates apply to any messages you send or receive.
• Opt-out: You may opt out at any time by replying STOP to any text message. You will receive one final confirmation message and no further texts unless you opt in again.
• Help: Reply HELP for assistance, or email team@stromation.com.

We will not send text messages outside of 8:00 AM to 9:00 PM Central Time. We do not share your phone number or SMS consent with third parties for marketing purposes. For full details, see the SMS section of our Privacy Policy.

8. Intellectual Property

All content on our Site -- including text, graphics, logos, images, page designs, blog articles, and software -- is the property of Stromation or its content creators and is protected by United States copyright and trademark laws.

You may not:

• Copy, reproduce, or distribute our content without written permission
• Use our name, logo, or branding to imply endorsement or affiliation
• Create derivative works based on our content
• Use our content for commercial purposes without authorization

• The actions, advice, or omissions of any matched real estate agent
• Errors, inaccuracies, or omissions in our Site content
• Service interruptions, technical failures, or data loss
• Unauthorized access to your information due to circumstances beyond our reasonable control

Our total liability to you for any claim arising from your use of our services shall not exceed the amount you paid to us, which is zero dollars ($0), since our service is free to consumers.

10. Indemnification

You agree to indemnify, defend, and hold harmless Stromation Homes and its owners, officers, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising from:

• Your use of our Site or services
• Your violation of these Terms
• Your violation of any applicable law or the rights of any third party
• Any information you provide to us that is inaccurate, misleading, or fraudulent

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Dallas County, Texas, and you consent to the jurisdiction of those courts.
